  28. California Court rules spanking with wooden spoon is not abuse.

A state appeals court and threw out chile abuse evidence on Tuesday. The evidence was of a Northern California mom who spanked her twelve year old daughter with a wooden spoon which caused bruising. Social workers turned Vernica Gonzalez into the state Department of Justice's child abuse database. The court appealed her case because social workers failed to see the family's entire situation. Gonzalez and her husband tried different kinds of punishments like grounding and taking her phone away because she wouldn't do her homework and would take part in gang culture. Family members said spankings were rare in the household. Justice Conrad Rushing said, ""the spanking was entirely the product of a genuine and deliberate disciplinary purpose, i.e., to arrest troubling behavior patterns exhibited by the daughter." It hasn't been proven to be a wooden spoon but further research will show the evidence.

This year, however, Kerr's neighbors are trying to take the trick out of her Halloween treat. Kerr received a 37-page temporary restraining order last Friday which seeks to shut down her haunted house. The case, filed in the District Court of Maryland, names Montgomery County as the plaintiff. Kerr and her employer, Silver Spring-based Pure Energy Real Estate, are listed as defendants. The neighbors in Kerr's neighborhood association say her haunted house, which also includes a cemetery in the backyard, creates a traffic and pedestrian safety hazard when thousands of visitors flock there each year. Kerr's "Haunted Garden" is open five nights in the month of October, from 7 to 10 p.m. Kerr's fans in the neighborhood and beyond have swarmed her home in support, making protest signs to keep the garden open. Kerr has hired an attorney and both parties will argue their case Tuesday in front of a Maryland District Court judge.
